Return Policy

Elara Maison Heritage Return Policy

If you are not fully satisfied with your purchase, Elara Maison Heritage accepts returns of unused or gently used items within 30 days of purchase.

Return Conditions:

  • Personalized or custom-made items are final sale and cannot be returned or exchanged.
  • Items must be returned in their original packaging and condition.
  • Refunds will be issued to the original method of payment.

At this time, we do not accept returns or exchanges for purchases made outside of our designated shipping regions.

Return Process:

To return an item, please complete the Return Form available in your order confirmation email. Include the form in your return package and attach the Return Label provided.

Returned packages must be prepaid and shipped to the address on the return label. Shipping fees are non-refundable. Processing time for returns is 10-15 business days.

Elara Maison Heritage Loyalty Program Terms and Conditions

1. Eligibility, Accounts, and Program Service

(a) Eligibility

The Elara Maison Heritage Loyalty Program ("Program") is open to individuals residing in countries where Elara Maison Heritage operates and delivers products. Membership is for personal, non-commercial use only. Participants must be 18 years of age or older.

  • One (1) account per individual is allowed.
  • Resellers and commercial buyers are excluded from Program participation and benefits.
  • If we mistakenly award status, points, or benefits to resellers, we reserve the right to invalidate those rewards, adjust the member’s status, and/or terminate the account.
  • If an account is found to be used for resale or commercial purposes, Elara Maison Heritage may suspend or permanently terminate the account.

(b) Accounts

To participate, users must register for a Program account. You can create an account through our official website www.elaramaison.com. No purchase is required for registration.

To register, you must provide:

  • A valid email address
  • A mobile phone number
  • Any additional required details for account verification

By creating an account, you acknowledge that Elara Maison Heritage may:

  1. Communicate with you regarding Program updates, exclusive offers, and promotional materials.
  2. Share your account details with trusted service providers for program management.
  3. Use and process your data as per the Elara Maison Heritage Privacy Policy.

You are responsible for keeping your account information current and maintaining the security of your login credentials. Elara Maison Heritage is not liable for points, status levels, or benefits lost due to account misuse, security breaches, or technical errors.

(c) Program Service

The Elara Maison Heritage Loyalty Program is accessible via www.elaramaison.com. The Program allows members to:

  • Access and redeem rewards and exclusive offers.
  • Update account information.
  • Reset passwords.

Program features may be modified or discontinued without prior notice. Use of any feature constitutes consent to data collection and processing for program management.

(d) Wireless Features

Certain Program features may be available via mobile devices (e.g., notifications, SMS updates, mobile app features). By using mobile-based services, you agree to:

  • Receive messages from Elara Maison Heritage via SMS or push notifications.
  • Update your contact details (e.g., phone number changes).
  • Accept that mobile carriers may charge standard SMS or data fees, which you are responsible for.

Some wireless features may be restricted or unavailable depending on your carrier and device.

2. Program Features

Program members are assigned a membership status ("Status") based on:

  1. The total amount spent on qualifying purchases.
  2. The number of qualifying purchases made within the last 12 months.

Each Status level comes with exclusive rewards and benefits. Members can track their status and rewards through their online accounts.

All time and date calculations for the Program follow Central European Time (CET).

(a) Membership Status

The Elara Maison Heritage Loyalty Program consists of four (4) membership tiers:

1. Pearl Status

  • Members with no qualifying purchases.
  • Members who have spent less than $350 in the last 12 months.

2. Silver Status

  • Members who have made two (2) or more qualifying purchases.
  • Total spend between $350 and $800 in the last 12 months.

3. Gold Status

  • Members who have made three (3) or more qualifying purchases.
  • Total spend between $800 and $1,600 in the last 12 months.
  • Members whose first purchase was at least $900 automatically qualify.

4. Platinum Status

  • Members who have made four (4) or more qualifying purchases.
  • Total spend exceeding $1,600 in the last 12 months.

(b) Maintaining and Upgrading Status

  • When registering, new members will be assigned a status based on their past 12-month purchase history (if applicable).
  • If a new member does not have a purchase history, they will start at Pearl Status.
  • Each status level is valid for 12 months.
  • Members can upgrade their status anytime by meeting both the spending and purchase requirements.
  • Once a member moves up to a higher tier, their 12-month period resets.

If a member does not meet the spending or purchase requirements by the end of their 12-month period, their status will be recalculated and adjusted accordingly.

Additional Terms

(c) Qualifying Purchases

Only purchases made through official Elara Maison Heritage sales channels (e.g., website, authorized showrooms) count as qualifying purchases. The following do not count:

  • Gift card purchases.
  • Discounted or clearance sale items.
  • Shipping fees and taxes.

(d) Benefits and Rewards

Each membership tier provides exclusive benefits, including:

  • Early access to new collections.
  • Exclusive discounts and special promotions.
  • Priority customer service and dedicated support.
  • Personalized design consultations (for Gold & Platinum members).

Rewards and benefits are subject to availability and may change at any time.

3. Program Adjustments and Disclaimers

(a) Modifications to the Program

Elara Maison Heritage reserves the right to:

  • Change, suspend, or terminate the Program at any time.
  • Modify the membership structure, reward system, and qualification criteria.
  • Adjust purchase eligibility, discounts, or rewards as necessary.

(b) Account Termination

Elara Maison Heritage may terminate a member’s account for:

  • Fraudulent activity or abuse of the Program.
  • Attempting to manipulate status or benefits.
  • Violation of program policies.

If an account is terminated, the member will forfeit all rewards and benefits.

(c) Data Privacy and Communications

By joining the Program, you consent to Elara Maison Heritage collecting and processing your personal data in accordance with our Privacy Policy. Members agree to receive emails, notifications, and SMS updates related to their account and rewards.

IN NO EVENT SHALL ELARA MAISON HERITAGE, ITS SUBSIDIARIES, AFFILIATES, FRANCHISEES, LICENSEES, ANY PARTICIPATING ELARA MAISON HERITAGE POINT OF SALE, AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE PROGRAM, THESE PROGRAM TERMS, OR ELARA MAISON HERITAGE'S OPERATION OF THE PROGRAM.

WITHOUT LIMITING THE FOREGOING, ALL ASPECTS OF THE PROGRAM, INCLUDING THE WEBSITE, PROGRAM SERVICES, BENEFITS, AND REWARDS, ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Elara Maison Heritage makes no guarantee that the Program, Website, or Services will be uninterrupted, timely, secure, or error-free. Elara Maison Heritage is not responsible for: (a) any loss, misdirection, or delay in receiving any member application, correspondence, Benefits, or redemption requests; (b) unauthorized redemption of Benefits or misuse of any reward; (c) actions or omissions of third parties; or (d) errors related to the Program, including but not limited to typographical errors, pricing inaccuracies, and technical malfunctions. Elara Maison Heritage reserves the right to correct any errors without prior notice.

7. Governing Law, Dispute Resolution & Class Action Waiver

All issues concerning the construction, validity, interpretation, and enforceability of these Program Terms, or the rights and obligations of members and Elara Maison Heritage in connection with the Program, shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to any conflict of law principles.

All disputes related to the Program or these Program Terms shall be resolved through binding arbitration. However, Elara Maison Heritage reserves the right to seek injunctive or equitable relief in the courts of Kraków, Poland, or any other court with jurisdiction over the member. Members agree that disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings.

NO CLASS ACTIONS: MEMBERS MAY ONLY BRING CLAIMS IN THEIR INDIVIDUAL CAPACITY, NOT AS A CLASS MEMBER OR REPRESENTATIVE IN ANY GROUP ACTION.

Arbitration proceedings will be conducted in Poland, and the decision of the arbitrator shall be final and binding. The applicable laws governing these Program Terms will apply throughout the arbitration. If any part of this section is found to be unenforceable, the dispute must be brought in a court of competent jurisdiction in Poland.

8. General Program Information

The Program and its content, including but not limited to trademarks, logos, and intellectual property, are the sole property of Elara Maison Heritage.

These Program Terms are void where prohibited by applicable law. The interpretation and application of these Terms are at the sole discretion of Elara Maison Heritage, and its determinations are final and binding.

Taxes may apply to Benefit accrual and/or redemption where required by law.

These Program Terms, along with any applicable Additional Terms, constitute the entire agreement between members and Elara Maison Heritage regarding the Program. They supersede all prior agreements, offers, and representations and may only be modified by an authorized representative of Elara Maison Heritage.

9. Updates to Program Terms

Elara Maison Heritage reserves the right to update, modify, or terminate these Program Terms at any time. Continued use of the Program constitutes acceptance of any modifications.

If the Program Terms are updated, the new version will be posted on the Website. Members are encouraged to periodically review these Terms and Conditions to remain informed of any changes. Elara Maison Heritage may notify members of changes via email or other reasonable means, but it is the member’s responsibility to stay informed.

If any provision in these Program Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Members may reject any changes to the Program Terms by terminating their membership in the Program. Continued participation after the Terms are updated constitutes acceptance of the new Terms.
